UCC'S ARE, IN MOST CASES, FILED WITH THE UCC DIVISION OF THE SECRETARY OF STATE'S
OFFICE. SEARCHES AND TERMINATIONS ARE ALSO AVAILABLE WITH THE TOWN/CITY CLERK WHERE THE
DEBTOR IS LOCATED. THEY ARE SUPPOSED TO BE FILED WITH THE COUNTY REGISTRY OF DEED'S OFFICE
WHEN FIXTURES ARE A PART OF THE COLLATERAL. HOWEVER, WE FIND MANY "REGULAR"
UCC'S ON RECORD AT THE COUNTY LEVEL AS MANY OUT-OF-STATE FINANCE COMPANIES ARE NOT
FAMILIAR WITH NEW HAMPSHIRE'S TOWN/CITY LEVEL FILING.
FEDERAL AND/OR STATE TAX LIENS ARE FILED WITH THE SECRETARY OF STATE'S OFFICE WHEN THE
LIEN IS AGAINST A BUSINESS. WHEN IT IS AGAINST AN INDIVIDUAL, IT IS FILED WITH THE
TOWN/CITY CLERK'S OFFICE AND WHEN REAL ESTATE IS INVOLVED, IT IS FILED WITH THE COUNTY
REGISTRY OF DEED'S OFFICE.
THE S.O.S. DOES NOT CROSS-INDEX MULTIPLE DEBTOR NAMES. THE COUNTY REGISTRY OF DEEDS
DOES CROSS-INDEX IN MOST CASES AND THE TOWN/CITY CLERKS VARY IN THEIR PROCEDURES. SOME DO
AUTOMATICALLY, SOME DO NOT AT ALL AND SOME WILL UPON REQUEST. IT IS BEST TO CALL PRIOR TO
THE FILING TO FIND OUT THEIR PROCEDURES.
